MEMBERSHIP AGREEMENT

PARTIES

1.a) This membership agreement is made between ILS GRUP AYAKKABI VE TEKSTİL SANAYİ VE TİCARET ANONİM ŞİRKETİ and the "Member," regarding the terms and conditions of benefiting from the services offered on the website www.iloveshoes.com.tr, operated by ILS GRUP AYAKKABI VE TEKSTİL SANAYİ VE TİCARET ANONİM ŞİRKETİ.

1.b) ILS GRUP AYAKKABI VE TEKSTİL SANAYİ VE TİCARET ANONİM ŞİRKETİ will be referred to as the "Company" individually and as the "Parties" collectively.

PURPOSE OF THE MEMBERSHIP AGREEMENT

2.a) The purpose of this agreement is to define the general usage terms, rules, and legal responsibilities of the "Member" regarding the use of the website www.iloveshoes.com.tr and the services offered on the platform.

2.b) Under this agreement, the Member intends to join the www.iloveshoes.com.tr platform managed by the Company, and to purchase products and/or services sold in the Virtual Store of the platform.

2.c) To establish a contractual relationship, the Member must fill in the required information, set a password, and grant the necessary approvals and permissions on the website www.iloveshoes.com.tr. In case of any missing membership details, the Member can contact the customer service or update their information via the website. The Member accepts that the Company holds no responsibility for any discrepancies in the provided information.

2.d) The Member agrees and undertakes that the personal and other information provided during the registration is correct and acknowledges that the Company is not responsible for any issues caused by incorrect information. The Member is solely responsible for any damage caused due to incorrect or outdated information.

2.e) The Member agrees to fulfill all legal obligations and procedures when wishing to make any legal or purchasing actions, including any products or advertisements displayed on the website. The Company bears no responsibility for any of these legal obligations and procedures.

2.f) All credit card and bank card transactions made by the Member on the website www.iloveshoes.com.tr are processed and approved directly between the Member and the relevant bank, credit institution, and/or payment service providers. The Company does not conduct or approve these transactions, and it does not store any payment method details unless the Member has specifically consented to saving credit card information for future purchases.

2.g) The Member undertakes to act in accordance with the terms of this agreement, all conditions specified on the website, the applicable legislation, and ethical rules during all actions and communications on the website. The Member is solely responsible for any legal or criminal liability resulting from their actions. The Company reserves the right to share the Member's information with the relevant authorities upon request.

2.h) The Company has taken measures to keep the website free from viruses and malicious software. However, the Member is responsible for ensuring the security of their own system and must provide their own antivirus software. By accessing the website, the Member accepts responsibility for any issues that may arise on their system as a result.

2.i) Each Member may have only one account. If multiple accounts are detected, the Company has the discretion to suspend or close the fake accounts without notice. The Member agrees to this condition.

2.j) The Company is not responsible for any direct or indirect damages resulting from violations, misconduct, or other reasons related to accessing or using the website.

2.k) The username and password created by the Member are solely the responsibility of the Member. The Company is not responsible for any actions performed using the Member's account, and the Member acknowledges their responsibility for all actions performed with their credentials.

2.l) The Company reserves the right to modify, reorganize, or discontinue any services, products, or content on the website at any time without prior notice. Any changes will become effective immediately upon posting on the website.

2.m) In accordance with Turkish Penal Code No. 5237 and other applicable laws, if the Member performs any illegal actions or causes harm to the Company, the Member is liable for compensating the Company's loss, including but not limited to any financial or legal penalties.

INTELLECTUAL PROPERTY

3.a) None of the materials on the www.iloveshoes.com.tr website (such as images, graphics, logos, etc.) may be modified, copied, reproduced, translated into another language, republished, uploaded to another computer, posted, transmitted, presented, or distributed without prior permission. Any such acts are subject to legal and criminal liability. All intellectual property rights belong to the Company.

PRIVACY AND COOKIE POLICY

4.a) www.iloveshoes.com.tr takes the security and protection of the Member’s personal data seriously, in accordance with the Personal Data Protection Law No. 6698 and other applicable laws. The Member consents to the collection, use, transfer, and processing of their personal data under these terms.

4.b) The Company may share the Member’s information with relevant authorities in compliance with the applicable laws.

4.c) Cookies are used to store browsing information and preferences. By using the site, the Member agrees to the use of cookies. The Company may also use cookies for marketing and promotional purposes.

FORCE MAJEURE

5.a) If a party is unable to fulfill its obligations under this agreement due to force majeure events (such as natural disasters, pandemics, etc.), the responsible party will not be held liable for delays or failure to fulfill these obligations.

TERMINATION OF THE AGREEMENT

6.a) The agreement is considered effective once the Member completes the registration process. The agreement will automatically terminate upon the Member’s cancellation or in case of any breach of the terms.

SENDING COMMERCIAL ELECTRONIC MESSAGES

7.a) By registering on the website and consenting to receive marketing communications, the Member agrees to be contacted through email, phone, SMS, and other means for promotional, marketing, and communication purposes.
